1. Agreement to Terms

By downloading, installing, or using AURA Sleep: Binaural Beats (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

These Terms constitute a legally binding agreement between you and DualRise Studio ("we," "our," or "us"), the developer of AURA.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws
• You will comply with these Terms and all applicable laws

3. License Grant

Subject to your compliance with these Terms, DualRise Studio grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on iOS devices that you own or control
• Use the App for personal, non-commercial purposes
• Access and use the features and functionality made available through the App

This license does not allow you to:

• Modify, reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Use the App for any illegal or unauthorized purpose
• Remove any copyright, trademark, or other proprietary notices
• Use the App to develop competing products or services

4. App Store Terms

These Terms are between you and DualRise Studio, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

You acknowledge that:

• These Terms do not override the App Store Terms of Service
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims related to the App

5. Medical Disclaimer & Safety

5.1 Not a Medical Device

AURA is a wellness and lifestyle application, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to:

• Insomnia or sleep disorders
• ADHD (Attention Deficit Hyperactivity Disorder)
• Anxiety disorders or depression
• Tinnitus or hearing disorders
• Any neurological or psychiatric condition

5.2 Consult a Healthcare Professional

If you have a sleep disorder, neurological condition, or are under medical care, consult a healthcare professional before using the App. Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the App.

5.3 Safety Precautions

When using the App, you agree to:

• Do not use while driving or operating machinery — Binaural beats can cause drowsiness and disorientation
• Do not use near bedtime with Energize presets — High Beta and Gamma frequencies can disrupt sleep
• Use headphones responsibly — Prolonged high-volume listening may cause hearing damage
• Start at low volume — Gradually increase to comfortable levels
• Discontinue if discomfort occurs — Stop use if you experience dizziness, nausea, or headaches

6. Intellectual Property

The App and its original content, features, and functionality are owned by DualRise Studio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

All audio algorithms, frequency generation methods, and user interface designs are proprietary to DualRise Studio. You may not copy, modify, or create derivative works based on the App without express written permission.

7. User Content

AURA does not currently support user-generated content. If this feature is added in the future:

• You retain ownership of any content you create
• You grant DualRise Studio a license to use, display, and distribute such content
• You represent that your content does not violate any third-party rights

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding data collection and use.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate these Terms at any time by deleting the App from your device. All provisions of these Terms that by their nature should survive termination shall survive.

10. Limitation of Liability

To the maximum extent permitted by applicable law, DualRise Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or health effects from using the App
• Loss of profits, data, or goodwill
• Service interruption or data loss
• Any other intangible losses

Our total liability to you for all claims arising from or relating to the App shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. DualRise Studio makes no warranties, expressed or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or effectiveness of binaural beats
• Uninterrupted or error-free service

We do not warrant that the App will meet your requirements or that any errors will be corrected.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
