1. Who may use AURA
These Terms are an agreement between you and DualRise Studio (“DualRise,” “we,” “us,” or “our”). You must be legally capable of entering this agreement. If you are under the age of majority, a parent or legal guardian must review and accept these Terms for you. AURA is not intended for children under 13.
AURA provides sound spaces, binaural beats, color noise, nature audio, mixing tools, timers, reminders, and related wellness features. Features may vary by device, territory, App version, and free or paid access.
2. AURA Pro purchases and subscriptions
Plans and confirmation
AURA may offer auto-renewable monthly or annual AURA Pro subscriptions, including promotional or introductory offers. The purchase screen and Apple confirmation sheet show the plan, localized price, billing period, and any trial or introductory terms before you confirm. Apple charges your Apple Account when purchase is confirmed.
Automatic renewal
An auto-renewable subscription continues for successive periods unless you cancel at least 24 hours before the end of the current period. Apple may charge your account for renewal within 24 hours before the period ends. Price and currency can vary by storefront and tax.
Trials and promotional offers
Eligibility is determined by Apple. Unless you cancel before a free or discounted introductory period ends, the subscription automatically converts to the standard paid plan shown at purchase. Any unused portion of a free trial may be forfeited when you purchase another subscription where applicable.
Manage, cancel, restore, and refund
Manage or cancel through iOS Settings → Apple Account → Subscriptions. Deleting AURA does not cancel a subscription. You can use “Restore Purchases” in AURA to restore an eligible entitlement under the same Apple Account. Apple handles billing and refund decisions; request a refund at reportaproblem.apple.com. Except where law requires otherwise, fees are non-refundable and cancellation takes effect after the current paid period.
Price or feature changes
Apple or DualRise may change plan availability or prices as permitted by law, with notice or consent where required. AURA Pro provides access to the paid features offered for your plan during an active entitlement; no particular feature or catalog item is guaranteed indefinitely.
3. Limited license and acceptable use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use AURA on Apple-branded products you own or control, subject to the App Store Usage Rules. You may also use it through Family Sharing where supported by the selected product.
You may not copy, redistribute, sell, rent, sublicense, reverse engineer, defeat access controls, extract or commercially exploit audio or other content, interfere with the App, introduce malicious code, misuse support, or use AURA unlawfully. All rights not expressly granted remain with DualRise and its licensors.
4. Wellness, hearing, and safety notice
AURA is a general wellness and relaxation product, not a medical device or healthcare service. It does not diagnose, treat, cure, prevent, or monitor insomnia, ADHD, anxiety, depression, tinnitus, hearing loss, or any other condition. References to sleep, focus, calm, frequencies, or masking describe intended wellness experiences and are not guarantees of results.
- Keep volume at a comfortable level and take breaks. Stop if you experience discomfort, headache, dizziness, agitation, or hearing symptoms.
- Do not use AURA while driving, cycling, operating machinery, or when environmental awareness is important.
- Binaural effects generally require stereo headphones, but headphones should not be worn where unsafe or contrary to medical advice.
- If you have a medical, neurological, psychiatric, sleep, or hearing condition, are pregnant, or have concerns about sound-based stimulation, consult a qualified professional before use.
- Do not delay or replace professional care because of AURA.
5. Apple-specific terms
You acknowledge that these Terms are between you and DualRise, not Apple Inc. Apple is not responsible for AURA or its content and has no obligation to provide maintenance or support. If AURA fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, to the extent required; Apple has no other warranty obligation.
DualRise, not Apple, is responsible for addressing claims relating to AURA, including product liability, legal or regulatory compliance, and consumer-protection claims, subject to these Terms. If a third party claims AURA infringes intellectual property rights, DualRise, not Apple, is responsible for investigation, defense, settlement, and discharge. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms. You represent that you are not in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a prohibited or restricted-party list.
6. Privacy and communications
Our Privacy Policy describes how information is processed. If you contact support, you authorize us to reply using the contact information you provide. Operational messages about purchases, safety, or important service changes are not marketing communications.
7. Availability and disclaimers
To the maximum extent permitted by law, AURA is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not promise uninterrupted operation, compatibility with every device or audio accessory, preservation of local data, specific wellness outcomes, or continued availability of any sound, feature, offer, or price. Nothing in these Terms excludes non-waivable consumer rights.
8. Limitation of liability
To the maximum extent permitted by law, DualRise and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or use, arising from AURA. Our aggregate liability for claims relating to AURA will not exceed the greater of the amount you paid us through Apple for AURA during the 12 months before the claim or US$50. These limits do not apply where prohibited or to liability that cannot legally be limited.
9. Suspension and termination
You may stop using AURA at any time; subscription cancellation is handled separately as described above. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, or misuse the service. Provisions that by nature should survive termination will survive.
10. Changes, law, and disputes
We may update AURA and these Terms. Material changes will be communicated as appropriate, and continued use after the effective date means you accept the revised Terms. If you do not accept them, stop using AURA and cancel any active subscription.
These Terms are governed by the laws of the State of California, excluding conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Courts with jurisdiction in California will hear disputes unless applicable law provides otherwise. Before filing a claim, please contact us and allow 30 days for an informal resolution.
